The Initial Agreement and Deposit

Once you and the buyer reach an agreement, you'll both sign the initial Purchase Agreement, and the buyer will place a deposit into escrow. The escrow, or closing agent, is a neutral third party, either a title company or attorney, that holds, receives, and distributes all funds related to the sale until closing.

Requirements vary by state, but for an agreement to be legally binding, it typically requires consideration: deposits held in escrow pending fulfillment of the contingencies outlined in the Purchase Agreement.

A few tips to streamline this stage of the process:

  • Keep written records of everything. Counter-offers, verbal agreements, and addendums should all be documented and signed by both parties. Tanaka Real Estate will help draft these records and provide copies for everyone involved.
